These Terms of Service ("Terms") govern your use of the Aapdu Ghar website and services ("Aapdu Ghar", "we", "us"). By using the platform you agree to these Terms. If you do not agree, please do not use it.

1. What Aapdu Ghar is

Aapdu Ghar is an online housing listing platform that connects people looking for accommodation with people offering it across Canada. We are a neutral venue only — we do not own, manage, inspect, lease, or guarantee any property, and we are not a party to any tenancy, agreement, payment, or arrangement between users. Any dealings you have with another user are solely between you and them.

Aapdu Ghar is built for the Indian community but is open to everyone. We do not discriminate on the basis of race, religion, nationality, ethnicity, gender, sexual orientation, or any other ground.

2. Eligibility & your account

• You must be at least 18 to create a listing or contact a landlord.
• You confirm that every detail you provide is accurate, truthful, and that you have the legal right to provide it (landlords must have lawful authority to rent the property they list).
• You are responsible for keeping your login secure and for all activity under your account.

3. Listing rules

If you post a listing, you agree to:

• Provide accurate descriptions, correct pricing, and real photos (at least one photo is required; a walkthrough video is recommended).
• Provide working contact details (at least one phone, WhatsApp, and email per listing; up to two more of each for shared management).
• List only properties legally available to rent in Canada, and honour the displayed price when a tenant contacts you.
• Keep your profile accurate so we can reach you, and respond to inquiries in a reasonable time.
• Not discriminate on any protected ground under applicable Canadian human-rights law.

Fair housing. Ethnic or community preferences (e.g. "Indian Preferred") are not permitted as tenant-selection filters. Gender preferences ("Girls / Boys Preferred") are allowed only for shared-accommodation / roommate situations (shared kitchen or bathroom), which fall under provincial human-rights exemptions for shared housing. Listings that discriminate against protected groups will be rejected.

Prohibited content. Do not post anything fraudulent or misleading, properties outside Canada, duplicate listings, or content that is illegal, discriminatory, or inappropriate. We may remove any listing or content, and suspend or terminate any account, at any time and without notice or refund if we believe these Terms have been broken.

4. Payments

• The first 51 listings ever posted are completely free — forever ("founding" listings; no card needed).
• After that, each listing costs CAD $20/month (plus applicable taxes) per property, processed securely by Stripe — billed at checkout and renewing monthly until cancelled.
• Cancel anytime from your dashboard ("Manage Billing"). Cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable.
• When a subscription ends, or a payment repeatedly fails, the listing is paused (hidden from Browse Listings) — never deleted. You can reactivate it anytime by restarting the subscription. Deleting a listing cancels its subscription automatically.
• We may change pricing with 30 days' notice.

5. Dealing with other users — your own risk

Browsing is free for tenants. All communication, viewings, payments, deposits, and rental agreements happen directly between users — Aapdu Ghar is never involved and is not a party to them.

• We do not verify the identity, background, character, immigration status, or creditworthiness of any user, nor the condition, ownership, legality, or availability of any property, beyond a basic listing review.
• You interact and transact entirely at your own risk. Always view a property in person, verify the other party, and never send a deposit or money before you are satisfied it is genuine.
• You are solely responsible for your own decisions, safety, and any agreement you enter into.

6. Public contact details & address

By default your contact details and exact address are kept private. You may optionally choose to display your phone, WhatsApp, email, and/or full address publicly — this is entirely your own choice and at your own risk. Aapdu Ghar is not responsible or liable for any consequence of that disclosure (unwanted contact, spam, misuse, or any resulting loss or harm). Anyone viewing a listing must not copy, repost, or share another person's details or address for any purpose other than a genuine inquiry.

7. Your content & our intellectual property

The Aapdu Ghar name, logo, and website are owned by us and may not be reproduced without written permission. Photos and videos you upload remain yours; by uploading them you grant us a non-exclusive licence to display them on the platform while your listing is active. You confirm you own them or have the right to use them, you can delete them anytime, and we will never use them to advertise elsewhere without your written consent. You are fully responsible for the content you post.

8. "As is" — no warranties

The platform is provided "as is" and "as available", with no warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or secure, that listings are accurate, or that you will find a tenant or a home. Any reliance on the platform is at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, Aapdu Ghar and its operator(s) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost deposits, money, profits, data, or harm, arising from your use of the platform or from any dealing, dispute, conduct, or content of any user. Our total aggregate liability to you for any and all claims is limited to the greater of (a) the total fees you paid us in the 12 months before the claim, or (b) CAD $100.

10. Release & indemnification

Because disputes between users are between them, you release Aapdu Ghar from any claim, demand, or damages of any kind arising out of any dispute or dealing with another user.

You agree to indemnify and hold harmless Aapdu Ghar and its operator(s) from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your listings, your content, your conduct, your use of the platform, or your breach of these Terms or of any law or third-party right.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and any dispute will be resolved in the courts of Ontario.

12. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us regarding the platform. We may update them from time to time; the "Last updated" date will change, and continued use means you accept the new Terms.
